Santa Fe, NM – Legislation that would toughen the punishment for repeat drunk drivers who continue getting in the driver’s seat when their licenses have been revoked or suspended as a result of a DWI conviction was pre-filed today by Rep. Paul Pacheco.

The bill, HB 81, would add a fourth-degree felony to a DWI charge when the offender is charged with a DWI while driving with a license that had already been revoked or suspended for a prior DWI offense.

“It’s not enough to suspend the licenses of repeat DWI offenders,” Pacheco said. “Even with a suspended license offenders are still getting behind the wheel. This bill will protect our families by creating a harsher punishment aimed at keeping offenders off of the roads.”

If passed the bill would also toughen the penalties for those who lend their car to someone with a revoked or suspended license due to DWI.

Albuquerque, NM – Democratic Party of New Mexico executive director Joe Kabourek released the following statement after Gov. Susana Martinez’s release Tuesday of her budget proposal:

“While we appreciate the Governor’s new interest in core Democratic programs like early childhood education, this budget does nothing to address the real issues facing our state: We are last in job creation and first in poverty.

“What’s more, Gov. Martinez has said absolutely nothing about plans to address the rampant corruption and ethics violations that have plagued her Administration. Until we address the culture of corruption in the Martinez Administration, no budget proposal will be able to take us from the being the worst-run state in the country to being the thriving economy that New Mexicans deserve.

“Further, Gov. Martinez’s Administration has made mistake after mistake in dealing with the federal government and that is costing New Mexico taxpayers millions of dollars. Does the Governor’s budget include the $16 million the state owes the federal government for her Administration’s Medicaid errors? Does it include funding to address the alarming gap in special education funding?”

Representative Nate Gentry Pre-Files Legislation to Keep New Mexicans Safer from Violent Repeat Criminals

“Jaydon’s Law” will provide judges with a full picture of defendants’ criminal histories during bonding and sentencing. 

Santa Fe, NM – Today, Representative Nate Gentry pre-filed “Jaydon’s Law,” legislation to ensure judges have access to the full criminal histories of violent offenders.

Current law prohibits judges from considering the juvenile record of an adult offender during bond and sentencing decisions.  Jaydon’s Law would change the Criminal Procedure Act to allow judges to review an adult defendant’s prior record as a youth offender.  It will also give judges access to other information, such as evidence presented during past hearings for youth offenses.

The bill would not apply to juvenile offenses committed prior to the age of 14 or to juvenile delinquent offenses.  It is targeted specifically at older juveniles found guilty of committing serious violent youth offenses such as second degree murder, aggravated battery, and rape.

“Some criminal defendants have committed multiple violent crimes as juveniles.  Currently, judges don’t have access to these records,” said Gentry.  “Jaydon’s law would allow judges to view a defendant’s full violent criminal history when making sentencing and pre-trial release decisions.  Passage of this bill will keep violent repeat offenders off our streets.”

The bill is named for Jaydon Chavez-Silver, an Albuquerque teen who was gunned down during a drive-by shooting while he was attending a house party.  Nicole Chavez, the mother of Jaydon Chavez-Silver, issued the following statement on Gentry’s bill:

“I would like to thank Representative Nate Gentry for pushing positive changes in order to have a safer state to live in.  Jaydon’s Law will give judges a true view of the offenders entire criminal history regarding violent crimes. This bill will allow judges to have the entire picture when making important decisions and help keep violent criminals off of our streets. I will never have Jaydon back, but Jaydon’s Law helps leave a great legacy behind regarding positive changes to the State of New Mexico in his name.”

With so much bad press the police get sometimes and even people saying New Mexico Is the “Land of Entrapment” I must say There are good cops out there,I’ve seen them with my own eyes,these types of cops will use there power to either smash you in very badly if your an evil doer,or they will use their power to work with you if you are trying to do good.With all the bad media and negativity against officers,I saw them help out a man today and it was pretty remarkable,so be positive when you see an officer and give them a salute,cause you never know you could be talking to one of God’s angels.I like to just say that the two officers I saw today let that guy go are truley the duke cities best of the best,stay safe,and we are all with you!.

There’s a new church opening up on Albuquerque’s Westside, MOSAIC! This church seems to be one of the best churches around, its seems to have a very good worship plan/system, not just going to church but being a part of the church, which seems to make a lot more sense. I’m glad the Duke City has Mosaic,I’m going to stop by one day,and I wish them the very best!

With an innate interest in New Mexico’s culture and its history surrounding Native Americans, Santa Fe artist Ralph Roybal began his career as an apprentice in some of the leading bronze foundries of the southwest. Beginning in his early twenties, it was at Santa Fe Bronze where, under the guidance of famous sculptor Ernest Berke, Ralph began to realize his potential in bronze work. Over the years, Ralph perfected his craft with an acute sense of detail and careful study and focus on the essence of natural patina though the use of polychrome. Much of his subject matter, based on influential 19th century North American Native tribes and tribal leaders, depicts notable figures like Geronimo, Black Hawk, Sitting Bull, and Crazy horse, to name a few, and has been exhibited in galleries from Denver to Houston, Scottsdale to Taos, and Santa Fe to Albuquerque. His well known works have also won many first place awards in various Fine Art exhibitions and shows, and can be found in the Permanent Collection of the Gilcrease Museum in Tulsa, Oklahoma.
Ralph’s studio, located in Rio Rancho, NM, allows him to personally create and complete all but the casting of his works. After detailing and applying the patinas, each bronze is signed, numbered and marked with his copyright. In July of 2010, his artwork was honored with a first-place award in the prestigious Contemporary Spanish Market held annually in Santa Fe, New Mexico.

Albuquerque, NM– Despite recent concerns raised by local media about New Mexico State Auditor Tim Keller using his office to advance partisan interests, as well as recently violating the state’s open records law, Tim Keller is now hosting a fundraising event with Democrat Party bosses.  His overtly political actions once again call into question whether he is able to perform his duties as state auditor in an objective manner.

“The increasingly political nature of the State Auditor’s Office is a grave concern for fair and honest elections and non-partisan government, oversight and accountability,” said Pat Garrett, spokesman for the Republican Party of New Mexico. “Tim Keller was elected to protect taxpayer dollars, but his only interest seems to be advancing partisan interests and his own ambition.”

A recent fundraising letter lists Tim Keller as a host for the event along with other elected officials up for re-election next year.

The State Auditor has vast influence over the election process. His liberal political leanings and activism give rise to a conflict of interest as he prepares to oversee the elections.

“The impartiality and objectivity of the State Auditor’s Office has been called into question once again,” Garrett concluded.

The fundraising letter, which clearly shows Keller’s involvement in partisan political activities, is attached to this press release. Below is further background information on Keller’s recent missteps:

New Mexico Political Report Correctly Stated That The Agency Had 15 Days To Respond To An Open Records Request To Be In Compliance With The Law— The New Mexico GOP Didn’t Receive A Response. “State agencies have fifteen days to respond to IPRA requests. On Wednesday, the Republican Party of New Mexico sent a letter to the Attorney General asking for action. In a press release sent to media on Wednesday afternoon, the party says it received no response from an IPRA request sent to State Auditor Tim Keller’s office on May 4. Abstract
Nationwide, more than 38 million women work in hourly jobs. Most women, and most Americans, are paid by the
hour, yet today’s workweek is changing—the 40 hour workweek and the 8-hour day are no longer the norm for a
significant part of this workforce. Our nation’s workplace protections are badly out of sync with the needs of today’s
working families and we need policies that provide everyone an opportunity to get ahead. Particularly, labor standards
have not kept up with rapid changes to the fastest growing industries like retail, healthcare, and food service. Part- time workers in the service sector—overwhelmingly women—have borne the greatest burden of these new just-in- time scheduling practices, which have largely gone unregulated. But what begins in these sectors will soon spread,
as the distinctions between part-time and full-time work grow increasingly blurred, and more and more Americans
experience work hour instability and economic uncertainty. Women − over a third of whom work part-time in order
to juggle: economic survival; family responsibilities; and advancing their careers − are at the greatest risk of being
further marginalized in the workforce if unsustainable scheduling practices on the part of employers go unchecked.
As we seek to create family-sustaining jobs in the burgeoning service sector, we must also consider scheduling
practices in low-wage employment. Without an update to labor standards for these workers, more and more
workers across the economy will be subject to this type of extreme economic uncertainty. New policies that ensure
predictable schedules, give employees a voice in their schedules, ensure quality part-time employment and access to
stable, full-time schedules will improve the lives of working people in general and especially benefit working women
and mothers.

Executive Summary
A majority of women are employed in hourly jobs, yet irregular work schedules and low-quality
part-time employment are straining women in the workforce in previously-unrecorded levels. The
unduly pressure, as documented through data and personal accounts in this report, means that
more than ever, women face fluctuating incomes and barriers to advancement in the workplace.
The precarious work schedules cause economic uncertainty and stress that is felt not just by
these women but also their families.
A third of workers have a fluctuating monthly income and 42 percent of them cite
irregular work schedules as the cause. Hourly workers experience these fluctuations more
acutely than do other workers. Nationwide, more than 38 million women (61 percent of all
women in the workforce) hold jobs paid on an hourly basis. Of women workers classified as
part-time, 83 percent are paid hourly. These jobs are disproportionately low-paying: 80 percent
of hourly part-time jobs for women pay below $15 per hour. Indeed, nearly half of all women
working hourly are employed in low-wage, yet fast growing sectors such as: health care, retail
and food service.
Twenty-five percent of women working part-time would prefer full-time work and half of
women working part-time cite childcare problems, family obligations, or education as the reason.
Yet, today’s workweek is changing: unpredictable schedules make planning childcare, class
schedules, and doctor’s appointments nearly impossible. Our nation’s workplace protections are
badly out of sync with the needs of today’s working families.
1. Employers increasingly require employees to offer full-time availability for part-time hours.
2. Part-time hourly workers suffer a pay penalty for being part-time, with wages
significantly lower per hour than hourly workers who have full-time schedules.
Thus while part-time work is often depicted as meeting workers’ needs for flexible work
schedules, part-time hourly work has become a source of economic insecurity and scheduling
uncertainty, especially for women and people of color.
New policies that ensure predictable schedules, give employees a voice in their schedules,
ensure quality part-time employment and access to stable, full-time schedules will improve the
lives of working people in general and especially benefit working women and mothers.
• Predictable schedules with stable hours and a reliable paycheck make it possible for
working people to plan ahead to meet their responsibilities on and off the job. Advance notice of
schedules, with predictability pay for last-minute additions and reporting pay for shortened and
on-call shifts, ensure that employers to establish stable, predictable scheduling practices.
• Employee voice in determining schedules allow employees to set reasonable limitations
on their schedules so that they can stay healthy, pursue educational opportunities, and spend
time with their families. The right to request specific scheduling accommodations, the right to
mutual consent to changes to the initial schedule, and the right to rest ensure that employer
decisions about scheduling and schedule changes reflect for employee input.
• Family-sustaining jobs allow people who work to support themselves and their families.
Access to adequate hours and guaranteed minimum hours along with pay parity between part- time and full-time employees will ensure that part-time workers are paid more fairly and are able
to transition to attain full-time work if they choose.

It seems as though in the past year or so there have been many stories of police abusing and killing what seems to be mostly African-American citizens.At first it seemed as just an isolated incident but now as the days progress,more and more stories are showing up in the media.

We at the Duke City Times are asking is our justice system broke? Is our society broke?do we have stereotypes and a status Quo to maintain that has reduced our police to attacking African American’s and African American’s being found  situations with the police,it possible that its not the police’s fault and its not African Americans fault,its all our fault,its Americas fault,whether we create strict laws that prevent abuses of power or we change our society to get rid of theses hidden discriminatory practices,this must stop,it must not carry on,the people of America cannot sit by and watch this go on,we have some serious question to ask ourselves,and for now lets just hope that peace may rest over the land.
